The Team helps global and domestic companies navigate the complex landscape of anti-dumping, countervailing duty and safeguard investigations, enabling them to increase their market access and gain competitive advantages in international trade.

International Trade at LKS

With one of the largest International Trade teams in India comprising of highly qualified and experienced lawyers, chartered accountants, cost accountants, US CPAs, economists and engineers, we provide the following services:

Full services in anti-dumping and countervailing duty investigations in India and across the globe with tie-ups with reputed international trade law firms around the world.
- Product scope reviews.
- Services include filing of questionnaire responses, making injury submissions, representations in oral hearings, assistance prior to, during and post the physical verifications visits.
- Review investigations, including sunset (expiry) reviews, mid-term or interim reviews, and new shipper reviews.
Assisting governments in World Trade Organization (WTO) litigation at Geneva, before the panel and appellate body.
Assisting Indian domestic industry, foreign producers/exporters, governments, importers, users and trade associations.
Developing pricing strategies within the framework of trade laws and then planning import/export.
Handling safeguard investigations, including quotas in international trade.
Litigation strategies with representation at all levels including Tribunal, High Courts and the Supreme Court of India.

Our experience and recent note-worthy assignments

Experience of handling more than 450 trade remedy investigations in India and other jurisdictions including in the United States of America, European Union, Gulf Cooperation Council (GCC), Turkey, Indonesia, Australia, Brazil, Canada, China, Mexico, Pakistan, Russia, South Africa, Thailand.
Represented a domestic industry association on imports of Printed Circuit Boards (PCBs) into India. Anti-dumping duty was imposed.
Represent foreign producers/exporters in Indian trade remedy investigations.
- Recently, lowest anti-dumping and countervailing duty rates were given in Saturated Fatty Alcohols from Indonesia, Malaysia and Thailand.
Represented an Indian importer in the anti-dumping investigation on Silicon Sealants from China PR – Historic 22 product exclusions from the product scope was granted.
Recent representations before the Apex Court:
- Represented a foreign exporter before the Supreme Court of India in a landmark judgement wherein the Court set aside the anti-dumping duty on Acrylonitrile Butadiene Rubber pursuant to a sunset review.
- Represented an Indian importer before the Supreme Court of India. The Court held that no duties can be levied in the gap period between end of provisional anti-dumping duty and start of definitive anti-dumping duty.
