In this edition, the Competition Law team discusses the new approach adopted by the Competition Commission of India (“CCI”) in dealing with cartels in two recent orders - despite finding the parties to be engaged in bid-rigging and cartelisation, the CCI refrained from imposing penalties. The team has reviewed recent competition law decisions regarding allegations of abuse of dominance against WhatsApp and Swiggy, amongst others. Some of the significant combinations discussed in this edition include (i) the acquisition of Emami Cement by Nuvoco Vistas Corp.; (ii) acquisition of Peugeot by Fiat Chrysler; and (iii) the global merger between Upjohn Inc. and Mylan N.V.
