This Update discusses the various antitrust and merger control decisions from the months of July & August, 2022. Some of the recent decisions in the competition space, including findings of collusive conduct by Chennai based Trailer Owner association and investigation into the practices of Bookmyshow for alleged abuse of dominance. The National Company Law Appellate Tribunal has also upheld CCI’s order setting aside predatory pricing against Whatsapp and the Karnataka High court has refused to interfere with CCI’s investigation in Intel’s case and imposed a cost of INR 10 lakh. On the merger control front, the CCI approved acquisition of sole control over Air Asia India ltd. by Tata’s Air India, corporate restructuring of GSK’s consumer healthcare divisions, amongst others. The headlining article in this edition discusses the fine line between the freedom of enterprises to choose their trading partners and exclusionary conduct under Indian competition law.
