India now has a comprehensive data privacy legislation called the Digital Personal Data Protection Act, 2023(“DPDPA”). Like its previous iterations, the DPDPA seeks to establish a regulatory body called the Data Protection Board of India, obligates data fiduciaries to undertake privacy compliances, provides for rights and duties of the data principals as a manifestation of their right to privacy, provides for adjudicatory and appellate procedures and prescribes penalties for contravention of the provisions.
Although the DPDPA retains the core aspects of the Bill introduced in 2022, the resulting changes may result in slightly different level of compliances for the Data Fiduciaries. There is definitely more than what meets the eye. To this end, Lakshmikumaran & Sridharan (LKS) is organising a seminar to discuss the implications of the new law, issues with implementation and the way ahead for corporate entities.
Considering that the DPDPA has not yet been implemented, stakeholders under it should explore applicable compliances to avoid high penalties prescribed under the new law. The supporting regulations (as and when they will be introduced), will further define (and refine) the privacy framework.
